  • 1. HELITECH a division of Slab Masters Inc. will be herein referred to as Helitech.
  • 2. Furnish labor and material for the installation of the following for the area in red on the accompanying drawing only of the building at the above address. The A. B. Chance Helical Wall Anchoring System will be taken to competent load bearing soil and/or bedrock:
  • A. Install 8 tieback(s) for horizontal movement. See the Addendum on the reverse side of this page.
  • 3. Work described in Item 2 above is to be completed within approximately 3 working days.
  • 4. HELITECH assumes normal construction and concrete thickness for purpose of this proposal and that such construction conforms with standard municipal codes. If existing construction and/or concrete are not of normal construction or do not meet the standard municipal building codes, or if previous concrete underpinning/piers are encountered, an additional charge may be required to prepare the effected area for proper installation. The property owner(s) or their agent(s) agree to pay such an additional charge pursuant to this contract if the above described event(s) are encountered.
  • 5. HELITECH will not be responsible for tile, carpet, paneling, appliances, air conditioners, outside plantings, etc. that need to be removed and replaced but will exercise reasonable care. The property owner(s) or their agent(s) bear the burden to investigate and disclose the existence of any underground facilities as the same may be amended, located in or near the areas which the property owner(s) or their agent(s) have requested HELITECH to excavate and/or repair. HELITECH will use reasonable care in the excavation and installation process, however, should a private utility or such underground facilities become impacted, the property owner(s) or their agent(s) shall be responsible for any repairs that may be necessary. The property owner(s) or their agent(s) are responsible for ensuring compliance with any and all laws, statutes and ordinances related to engaging in sub-surface activities on the property owner(s) property including, but not limited to, notice and filing requirements. The property owner(s) or their agent(s) shall indemnify and hold HELITECH harmless for any consequential sub-surface damage caused by HELITECH as a result of the property owner(s) or their agent(s) failure to notify and their burden hereunder.
  • 6. All above work described in Item 2 above shall be returned to the owner for repair will be returned as close to the original condition as possible. HELITECH will back-fill and compact with effort for tieback installation.
  • 7. Customer will remove all items away from the wall to provide a six (6) foot work area, including the following: all items along the work area, wood, deck, and AC unit.
  • 8. HELITECH will provide a lien waiver upon completion and final payment.
  • 9. HELITECH will "V" straighten | | Stabilize only as much as structural integrity will allow, as determined by HELITECH.
  • 10. We will install 6" C" channels at 2 wall anchor location(s).
  • 11. HELITECH will apply a flexible, polymer-enhanced membrane and 1/4" foundation drain board to the excavated foundation wall (approximately 381 s.f.). Customer acknowledges there is no warranty with this line item.

Limited Warranty

  • THE WORK TO BE PERFORMED UNDER THIS AGREEMENT IS GUARANTEED FOR THE LIFE OF THE STRUCTURE AGAINST ALL DEFECTS IN MATERIALS AND WORKMANSHIP. THIS WARRANTY IS TRANSFERABLE IN ITS ENTIRETY TO SUBSEQUENT PROPERTY OWNERS, PROVIDED THAT A WRITTEN ASSIGNMENT IS PROPERLY EXECUTED BY OUR CUSTOMER PRIOR TO THE SALE OF THE PROPERTY. IF ANY HORIZONTAL MOVEMENT OCCURS IN THE AREA DESCRIBED IN PARAGRAPH 1 ABOVE, OTHER THAN SETTLEMENT OR MOVEMENT CAUSED BY AN EARTHQUAKE, SEVERE WIND, FLOOD, SLOPE OR HILL MOVEMENT, CHEMICAL CHANGE IN THE SOIL, ACT OF GOD, OR SIMILAR MAN-MADE CONDITIONS INCLUDING, BUT NOT LIMITED TO, EXPLOSIONS, IMPROPER DRAINAGE, OR ABANDONMENT OF BUILDING, THEN HELITECH WILL AT NO COST OR EXPENSE TO THE PROPERTY OWNER(S), CORRECT ANY DEFECT IN WORKMANSHIP OR MATERIALS THAT MAY HAVE OCCURRED IN ORDER TO STABILIZE SUCH AREA PROVIDED THAT THE AREA TO BE CORRECTED IS ACCESSIBLE. IF PREVIOUS WORK WAS COMPLETED BY ANOTHER COMPANY, HELITECH CANNOT ASSUME ANY OF THEIR WARRANTIES.
  • THE FOREGOING IS OUR SOLE WARRANTY. ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY AND WARRANTY OF FITNESS FOR PURPOSE, ARE EXCLUDED. YOUR EXCLUSIVE REMEDY SHALL BE FOR CORRECTION OF ANY DEFECT IN WORKMANSHIP AND MATERIALS, AS SET FORTH ABOVE. IN NO EVENT SHALL HELITECH BE LIABLE FOR CONSEQUENTIAL DAMAGES, REGARDLESS OF WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT, OR OTHERWISE.

  • All material is guaranteed to be as specified. All work to be completed in a workmanlike manner according to standard practices. If you do not pay as and when required by this contract, however, all guarantees by it will be void and a 1½% per month interest charge will accrue and you will pay all costs related to the collection of the amount, including reasonable attorney’s fees and court costs. Any alteration or deviation from above specifications involving extra costs will be executed only upon written orders, and will become an extra charge over and above the estimate. All agreements are contingent upon absence of strikes, accidents or delays beyond our control. Owner to carry fire, tornado and other necessary insurance. Our workers are fully covered by Workers’ Compensation Insurance. This contract contains all of the terms and conditions agreed to by the parties and no other representations, warranties or agreements, express or implied, shall vary the terms of this contract.
  • NOTE: This proposal may be withdrawn by Helitech if not accepted within 20 days.
  • YOU, THE CONSUMER, MAY CANCEL THIS TRANSACTION AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD DAY AFTER THE DATE OF THIS TRANSACTION. SEE THE ATTACHED NOTICE OF CANCELLATION FORM FOR AN EXPLANATION OF THIS RIGHT.
  • Acceptance of Proposal - The above prices, specifications and conditions are satisfactory and are hereby accepted. HELITECH a division of Slab Masters Inc. is authorized to do the work as specified. Payment will be made as outlined above.
