ASSISTANT ATTORNEY GENERAL, STATE OF UTAH, OFFICE OF ATTORNEY GENERAL, NATURAL RESOURCES DEPARTMENT, PUBLIC LANDS SECTION   October, 2011 - Present

  • Provide representation for Utah Public Lands Policy Coordinating Office in federal and state court litigation, administrative proceedings, legislative hearings, and public land management planning processes to achieve statutory responsibilities and strategic objectives, priorities, and goals.
  • Provide legal assessments and recommendations to legislative and executive branch committees and officials regarding federal government action affecting State interests and probable outcomes.
  • Develop solutions to public land management disagreements.
  • Supervise litigation of state interpretations, challenges, and remedies under various federal statutes, including the National Environmental Policy Act (NEPA); the Federal Land Policy and Management Act (FLPMA); the National Historic Preservation Act (NHPA).
  • Draft and review pleadings, memoranda/briefs in Utah and Federal District and Appellate Courts (including Utah and United States Supreme Court), and administrative agency proceedings. Conduct trial proceedings and present arguments.
  • Prepare and review policy documents, including comments, consistency reviews, objections, concurrences, and challenges to federal public land management actions.
  • Analyze proposed legislation for potential impacts and constitutional issues. Provide legal advice to state officials concerning probable effects.
  • Coordinate with Attorney General offices across jurisdictions and local governments within Utah to address shared concerns or develop joint initiatives.
  • Provide testimony to legislative committees, advise Attorney General Executive Committee, and deliver presentations to county commissions and outside stakeholders on public lands issues.
  • Supervise, advise, and mentor attorneys on best practices for case preparation, courtroom technique, and professional development opportunities.
  • Develop and implement Section and Agency policies and procedures; oversee Section operations, including hiring and budget decisions, performance evaluations, and employee relations.
  • Maintain management training to update, implement, and maximize change initiatives.
