TERMS OF DEBT RECOVERY PROGRAM
In order for us to provide the services of our Debt Recovery Program (DRP), the Client agrees to the following with the terms as defined in the New Client Agreement.
1. The DRP is established to repay Client's debts.
2. CGA will not lend Client money to repay debts.
3. Client will provide CGA with the financial information requested by CGA, related to Client's accounts under the DRP. Client authorizes CGA to pull Client's credit report if necessary.
4. Client authorizes CGA to discuss their financial condition with Clients Listed Creditors, to disclose any information they request as part of our effort to obtain their cooperation and consent, and to receive financial information from creditors related to Listed Accounts. Client releases each Listed Creditor from any liability that results from their disclosure of your account information to CGA.
5. Client authorizes CGA to withdraw or "debit" Monthly Payment from Clients Bank Account beginning on First Debit Date and on the Debit Date each month thereafter. CGA will continue to debit Clients account until (i) all of the Listed Debts are paid in full; (ii) this agreement is terminated; (iii) Client notifies CGA in writing to stop the debits.
6. CGA will stop debits from Clients Bank Account if we receive a termination request within 10 business days prior to the next scheduled Debit Date. If CGA does not receive a notice, we cannot guarantee that a Monthly Payment will not be debited from Clients Account.
7. Some Creditors require that all Clients' credit cards must be surrendered to Client's Creditors for destruction, even if they are not included on the DRP. Creditors reserve the right to close any account placed on the DRP. Consult your counselor to determine if this applies to your Creditors.
8. Interest, finance charges, late fees, and other charges are matters of contract between the Client and Listed Creditors. The reduction, elimination or adjustment of the creditor charges related to Clients Listed Accounts are matters of discretion exercised solely by a Listed Creditor.
9. If the DRP agreement is terminated, the consumer is entitled to a prompt refund of any payments made that have not yet been disbursed to the consumer's creditors.
10. Payments made to CGA under the DRP will be deposited into our Bank of America Trust Account (625 N Flagler Drive, West Palm Beach, FL 33401) under the name of CreditGUARD of America.
11. CGA is a nonprofit corporation supported by voluntary creditor donations (fair share). CGA services are provided without regard to contributions made in support of our activities. Some services may be provided by a Third Party Vendor.
12. Unless otherwise restricted by law in Clients contract state, Client will pay CGA $20 for every returned item rejected from Clients Bank for insufficient funds or otherwise. CGA is authorized to debit this amount from Clients Bank Account for an amount equal to the maximum permissible charge up to $20.
13. CGA does not notify credit reporting agencies of Clients participation in the DRP. CGA is not responsible for any possible changes to Clients credit report, based on information reported by the Listed Creditors.
14. Client may examine account records during normal business hours at our normal place of business or request copies of Clients records by mail or facsimile.
15. CGA employees, officers, trustees, attorneys and agents are not liable for any claim, suit, or damages resulting from or arising out of any action or omission taken by Clients creditors, except for any claim, suit or damage arising from negligence on CGA's part or any of CGA's employees, officers trustees, attorneys or agents. Nothing herein shall apply to actions or claims under the provisions of the United States Bankruptcy Code, 11 U.S.C. sec. 101 et seq.
16. CGA has obtained an insurance policy for $1,000,000 - Policy # CCP 0062364 08.
17. CURRENT ACCOUNT DISCLOSURE: A "current account" can be assessed late fees during the transition period, which is usually one to three months depending on the creditor, until the account is re-aged, which means to bring it to a current status. Entering a DRP may negatively affect a Clients credit rating and credit score. But, if you have other accounts that are behind, your credit history has already been affected.
18. Clients agreement with CGA shall terminate upon: (i) payment in full all Listed Debts; (ii) violation of any of the terms of the New Client Agreement; or (iii) mutual agreement. Either party may terminate the DRP agreement upon ten days' written notice to the other party. Notice of cancellation of Clients participation in the DRP must be received in writing or in our office via mail, registered mail is recommended.
19. Only the debts listed on the Creditor Listing are part of the DRP. Any unlisted debts remain the Clients sole responsibility.
20. CGA requires a 5 Business Day notice for any SafePay changes to be made.
21. CGA allows 8 days for Clients SafePay debit funds to clear. Clients funds will be disbursed to creditor immediately upon clearing.
22. If Client terminates this agreement prior to First Payment Date, Client will receive a refund of $50.00.
23. CGA does not receive monthly statements from your creditors. It is the client's responsibility to monitor the monthly statements from their creditors as well as from CGA and to report any inconsistencies to CGA immediately. The forms and schedules in this fax packet contain the complete Agreement between the Client and CGA regarding the DRP. All questions concerning the construction, validity, and the interpretation of this Agreement will be governed by the laws of the state of Florida without reference to any conflict of law rules. Unless otherwise provided to the contrary, any and all disputes between CGA and Client that cannot be resolved shall be determined solely and exclusively by arbitration in accordance with the Rules of the American Arbitration Association.
24. This contract shall be interpreted in accordance with law of Florida. Venue for any litigation arising as a result of contract shall be exclusively in Palm Beach County in the state of Florida.
25. The forms and schedules in this fax packet contain the complete Agreement between the Client and CGA regarding the DRP. All questions concerning the construction, validity, and the interpretation of this Agreement will be governed by the laws of the state of Florida without reference to any conflict of law rules.
26. Unless otherwise provided to the contrary, any and all disputes between CGA and Client that cannot be resolved shall be determined solely and exclusively by arbitration in accordance with the Rules of the American Arbitration Association.
