  • Q: What is paid sick leave?
  • A: An IHSS provider who works for an IHSS recipient, can be paid sick leave. Providers become eligible for paid sick leave after working 100 hours of providing authorized services for an IHSS recipient after their initial hire date. Once the provider is eligible for paid sick leave the paid sick leave cannot be used until an additional 200 hours of authorized services have been worked or until after 60 calendar days have passed, whichever comes first.
  • Beginning July 1, 2024, IHSS providers are now eligible to receive 40 hours of paid sick leave. Each year, any earned sick leave hours IHSS providers have will expire on June 30th.
  • If you are a new provider and have not yet earned your sick leave hours by working a total of 100 hours providing authorized services to one or more IHSS recipient(s), you will get your 40 hours once you have worked the required 100 hours. You may begin using your 40 hours of paid sick leave once you have worked an additional 200 hours or 60 calendar days, whichever comes first.
  • Q: It’s after July 1st, but I don’t have any sick leave hours yet? How do I earn sick leave?
  • A: You must first work 100 hours to earn paid sick leave. Once you have earned paid sick leave, you must work an additional 200 hours, or wait 60 calendar days to be able to claim/request the sick leave.
  • Q: Will I get more than 40 hours of paid sick leave in the future?
  • A: If your paid sick leave hours do increase, you will receive a notice from CDSS. Effective July 1, 2024, IHSS providers will be eligible to receive 40 hours of paid sick leave. At this time, we are not aware of any other increases to provider sick leave.
  • Q: What is a Fiscal Year?
  • A: The Fiscal Year is from July 1 to June 30 of the next year.
  • Q: What can I use paid sick leave for?
  • A: You can use your paid sick leave if you are sick, need to go to a medical appointment, or need to get services because you have been a victim of abuse. You can also use paid sick leave for the family members listed on the form.
  • Q: How do I find a backup provider?
  • A: Please contact your local IHSS County office if you need assistance to find a backup provider.
  • Q: How do I submit a claim for paid sick leave?
  • A: You can do this in two ways, fill out a paper-copy of the Sick Leave Request Form (SOC 2302) and mail the completed SOC 2302 to the address written on the form, or submit a sick leave request on the IHSS Electronic Services Portal (ESP).
  • Q: Does my recipient have to sign my leave sick claim form?
  • A: No, your recipient doesn’t need to sign your sick leave claim form.
  • Q: Where do I send my sick leave claim form for processing?

  • Q: What if I make a mistake when I complete the paper version of the sick leave claim form?
  • A: The SOC 2302 must be completed correctly in order to be processed. If a SOC 2302 is received not completed correctly, it will be returned to the provider with the IHSS Program Notice to Provider of Incomplete Paid Sick Leave Request Form (SOC 2303) with instructions to complete the SOC 2302 correctly.
  • Q: Should I make a copy of the completed sick leave claim form that I mail to the Sick Leave Processing Center to keep with my own records?
  • A: Yes. It is always a good practice to keep a copy of a mailed form for your own records.
  • Q: How much sick leave can I claim per incident?
  • A: When claiming sick leave, you must use a minimum of 1 hour per claim. If you need to use more than 1 hour in a single claim, you can claim time in increments of 30 minutes after the 1st hour. You can use your entire sick leave balance at once if needed. If your remaining balance becomes 30 minutes, you can claim less than the minimum of 1 hours in that instance.
  • Q: Where can I obtain a Sick Leave Request Form (SOC 2302)?
  • A: The SOC 2302 form is available on the CDSS Website or through your IHSS County Office. Or you can use the IHSS Electronic Services Portal (ESP) to submit a sick leave request electronically.
  • Q: Can I cash out my sick leave?
  • A: No. You must use any earned sick leave by the end of the Fiscal Year June 30th. Any unused sick leave will be lost after June 30th.
  • Q: How do I earn sick leave again once I use it?
  • A: Once you meet the requirements and become eligible to claim sick leave, your allotment of sick leave for the fiscal year will be provided to you every July 1.
  • Q: Does my sick leave balance carry-over to the next year? Am I paid for unused sick leave?
  • A: No. Any unused sick leave does not carry-over to the next fiscal year. You are not paid for sick leave time that is not used by the end of the fiscal year.
  • Q: Do I need a backup provider for my recipient so I can claim my sick leave?
  • A: Please work with your recipient or local IHSS County office to find a backup provider if needed.
  • Q: How many sick leave hours do I have remaining?
  • A: You can see this information on your pay stub, or please contact your local IHSS County Office. If you have an account at the IHSS Electronic Services Portal (ESP), you can see your remaining hours when you log in to your account.
  • Q: Do I have to provide a notice to my recipient?
  • A: If you know ahead of time you need time off, give at least 48 hours’ notice to your recipient. If you have an emergency, you should give at least 2 hours’ notice to your recipient.
  • Q: Will my paid sick leave be paid to me in the same warrant as my regular payment?
  • A: Paid sick leave will be mailed to providers in a separate warrant from their regular payment. The sick leave payment will not be included on a warrant for regular hours that may be processed on the same day. Sick leave payments are considered income for the purposes of Federal and State income taxes. However, if a Live-In Self-Certification Form (SOC 2298) has been processed for the provider, the income will be excluded from income taxation.
  • Q: Can I receive my paid sick leave as a direct deposit to my checking or savings account?
  • A: Yes. If a provider is signed up for direct deposit, the sick leave payment will be delivered via direct deposit.
