  • Examine documentation of assigned cases in which enforcement actions (fines, suspensions, closures of operations , etc.) have been initiated due to non-compliance with applicable regulations by motor carriers, to identify and assimilate all relevant factors, to verify accuracy of established civil penalties, and to inform the affected motor carriers of the enforcement actions assessed against them and of their options, under applicable laws and regulations, for responding to the enforcement actions to identify variables in individual cases to establish a range within which the final penalty content of specific cases can be negotiated.
  • Receive and respond to notices of penalties sent to subject firms and take appropriate actions according to the content of each response.
  • Arrange meetings with representatives of firms that request revisions/negotiations of penalties to examine assessed penalty content and details of the firms' current status to negotiate amounts, conditions and schedules for satisfying the determined penalty assessments according to legal requirements and the Department's regulatory standards.
  • Document results of the negotiations and route them to Motor Carrier management for approval and implementation; process approved or revised negotiated settlements for further processing and filing.
  • Study, learn, and apply the rules of evidence, legal terminology and composition, including format, sequencing of subject matter and related controls and guidelines for legal documents to participate in expressing findings of case contents and negotiations in a legally acceptable manner.
  • May testify before administrative hearings and courts of jurisdiction.
