  • Statement of Harm: I worked for AU as an overnight security officer for its University Mall station at 2200 E Fowler Ave., Tampa, FL 33612 location beginning in October 2021. Throughout my tenure with AU, I was subjected to disparate treatment and harassment on account of my race. For example, Nimmo (last name unknown, Caucasian), supervisory guard, would refuse to allow me to perform any duties other than dispatch, while he could freely walk the floors. Nimmo also called me, “Nigger” over the radio in lieu of my actual name, only a short time after I was hired. In response, I said, “Excuse me? What did you say?”, but Nimmo doubled down and reiterated the slur for clarity. Accordingly, I reported the incident to Austin (last name unknown, Caucasian), account manager, and sent a separate text message to Manny Monge describing the same. However, no remedial action was taken to address the incident.
  • As a result of AU’s lack of action, Nimmo’s harassment and discrimination toward me grew increasingly hostile. A short time after the aforementioned incident, Nimmo screamed at me over the radio, specifically stating, “If you want your fucking job, you will shut your fucking mouth.” I of course responded that I wished he would not speak to me like that, but Nimmo persisted in berating me over the radio.
  • Once again, I reported the incident and the other instances of racial discrimination to Austin. After submitting my sixth complaint, Austin responded that he would address the ongoing issues with Nimmo in the coming days. In response, I advised Austin that Nimmo told me “if I said one more word I would be sent home and fired.” Austin responded, “Well, you have to respond to him,” to which I replied, “I do respond to him, but I don’t need to be treated like that.”

  • Approximately a few weeks later, Austin informed me that Nimmo was being transferred to another assignment. However, around November 15, 2022, Austin reached out to me to inform me that I was being taken off the University Mall site, Nimmo would be returning to his previous position, and I was terminated under pretext.
  • Statement of Discrimination: I was discriminated against because of my race in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. §§ 2000e, et seq., 42 U.S.C. § 1981, and Section 760.10, of the Florida Civil Rights Act.
