The JD North America Employee Dispute Resolution Plan is intended to facilitate the prompt, fair, and inexpensive resolution of legal disputes between JD North America and its employees.

AAA's Employment Arbitration Rules and Mediation Procedures
Federal Arbitration Act (the Act)
Controlling substantive law of the State of Indiana, unless controlling state laws require the application of a particular state's substantive law
Employee is not precluded from filing a complaint or participating in an investigation or proceeding with administrative agencies such as the United States Equal Employment Opportunity Commission, the United States Department of Labor, and the National Labor Relations Board
All claims between JD North America and Employee will be brought on an individual basis, and not as part of a representative, collective, or class action
A party seeking to initiate a claim under the Plan must file a demand with the AAA within the applicable time period established by the governing statute of limitations
Arbitrator selection process involving a list of arbitrators provided by the AAA
Arbitration shall take place in the county where the Employee was last employed or sought to be employed by JD North America
Discovery shall be conducted in accordance with the Federal Rules of Civil Procedure, subject to any restrictions imposed by the arbitrator or the Plan
All current and former employees and applicants for employment of JD North America residing in the United States or otherwise subject to the relevant laws of the United States
Arbitrator's authority to dismiss claims subject to dismissal under the Federal Rules of Civil Procedure and hear dispositive motions
Arbitrator's discretion to permit the filing of post-hearing briefs
All arbitration expenses, including the costs of the arbitrator and AAA, shall be borne in accordance with the Costs of Arbitration section of the AAA's Employment Arbitration Rules
JD North America may amend or terminate the Plan at any time, but such amendment or termination shall not be applicable to a legal claim or dispute that arose prior to the date of the amendment or termination
Application for employment, initial employment, or continued employment on or after the effective date of the Plan constitutes consent and agreement by both the Employee and JD North America to be bound by the Plan
The Plan contains the complete agreement of the parties on the subject matter herein and supersedes all prior or contemporaneous oral or written understandings on the matter
The provisions of the Plan are severable. If any one or more provisions are determined to be void or otherwise unenforceable, the remaining provisions shall continue to be in full force and effect
Enforcement of the Plan is not conditioned upon the signature of the Employee or JD North America
